Facing fraud guidelines of 24-30 months incarceration – client gets no jail time

Client was accused of a variety of federal fraud offenses including tax and wire fraud. After extensive negotiations with the prosecutors, client pled to misdemeanor charges in federal court. The case proceeded to sentencing and the presentence report recommended sentencing guidelines of imprisonment for a period of 24-30 months. The prosecuting attorney vigorously argued for a sentence of 24 months imprisonment. Attorney Carmichael conducted thorough research and drafted a robust argument against this guidelines calculation. The Court agreed with the defense argument on one of the applied enhancements and reduced the guidelines calculation range to 18-24 months imprisonment. The government counsel continued to seek a sentence of 24 months incarceration. Following a lengthy, hearing with forceful arguments from both sides, the Court granted the defense request for a sentence of probation. The client was spared any incarceration and was allowed to remain at home with family.
